Terms of Service

Welcome to Thrine. These Terms of Service ("Terms") govern your access to and use of the Thrine website at thrine.app, its editor, templates, exports and embeds (together, the "Service"), operated by Thrine ("Thrine", "we", "us").

By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Thrine lets you make 3D scenes for the web: bring a 3D model, text or an SVG, style it with looks, materials, lighting and animation, and export it as an image, a video, or an embed you place on your own website.

2. Beta

The Service is in beta. Access may be limited to invited accounts, and features may change, break or be removed without notice. Keep your own copies of anything important to you.

3. Eligibility

You must be at least 13 years old to use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

4. Accounts

You sign in with Google or with a link we email you, so the security of your account depends on the security of that Google account or email inbox. You are responsible for all activity under your account. Tell us at hello@thrine.app if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms.

5. Your content

You keep ownership of everything you upload or create in the Service: 3D models, drawings, images, videos, text and projects ("Your Content").

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, render and display Your Content only as needed to operate the Service: for example, to save your projects, draw their previews, and serve your embeds to everyone who views them. This licence ends when you delete Your Content, except for copies in backups, which expire after a short time.

You are responsible for Your Content. You must own it or have permission to use it, and it must not infringe anyone else's rights. Do not upload 3D models, images, videos, fonts or logos you do not have the right to use.

6. What you make with Thrine

The images, videos and embeds you make from your projects are yours to use in personal and commercial work, including work for clients, subject to the rights in Your Content.

The templates, looks, materials, animations, sample models and other assets the Service provides remain ours or our licensors'. You may use them as part of what you make with Thrine, but you may not extract, redistribute or resell them on their own, or as a competing template pack, asset library or tool.

Fonts and icons in the Service are provided under their own licences (for example, the SIL Open Font License), which also apply. Brand logos in the icon library are trademarks of their owners: use one only where you have the right to.

7. Embeds

An embed is loaded from our servers each time it is viewed, and anyone who can see the page it is on can view it. An embed shows the scene as it was when you created it; to change what a website shows, create a new embed and place its code there.

Embeds depend on the Service being available. We may limit, suspend or remove an embed that breaches these Terms or puts excessive load on the Service. If your account is closed, its embeds stop working.

8. Acceptable use

You agree not to:

  • Use the Service to make or distribute unlawful, infringing, harmful, hateful or deceptive material
  • Use embeds to impersonate others, phish, or mislead the visitors of a website
  • Upload malware, or files made to exploit or disrupt the Service or its users
  • Scrape, bulk-download or systematically extract templates, looks or assets outside the intended interfaces
  • Circumvent rate limits, upload limits, access controls or authentication
  • Resell, sublicense or repackage the Service or its catalogue as your own offering
  • Reverse engineer the Service, except to the extent that this restriction is unenforceable by law
  • Interfere with, overload or disrupt the Service or its infrastructure

If you believe content on Thrine infringes your rights, write to hello@thrine.app with the details and we will look into it.

9. Free and paid plans

The Service is free during the beta. We may introduce paid plans, usage limits or premium features at any time.

If you purchase a paid plan, its pricing, billing cycle and refund terms will be presented at checkout and form part of these Terms. Fees are exclusive of taxes unless stated otherwise. Unless required by law or stated at purchase, fees are non-refundable. We may change pricing with reasonable notice; changes will not affect a billing period already paid for.

10. Third-party services

The Service works with third-party services, such as Google for sign-in, and your embeds run on websites we do not control. We are not responsible for third-party services, and your use of them is governed by their own terms.

11. Intellectual property

The Service, including the website, editor, templates, looks, documentation and branding, is owned by Thrine and protected by applicable intellectual property laws. Except for the rights these Terms expressly grant, no rights are transferred to you. The Thrine name and logo may not be used without our prior written permission.

12. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, add to or discontinue any part of the Service, including individual templates and looks, at any time. Images and videos you have already exported are yours and are unaffected.

13. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

You use the Service and what it produces at your own risk.

14. Limitation of liability

To the maximum extent permitted by law, Thrine and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising from or related to your use of the Service.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnity

You agree to indemnify and hold harmless Thrine and its team from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, the websites where you place embeds, or your breach of these Terms.

16. Termination

You may stop using the Service at any time, and you may ask us to delete your account by writing to hello@thrine.app. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service.

Sections 5, 6, 11, 13, 14, 15 and 18 survive termination.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above and, where appropriate, announced in the Service. Continued use after changes take effect constitutes acceptance.

18. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

19. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition or sale of assets.
